Data Subject Access Request

At Compassionate Healthcare Jersey, we respect every person’s right to understand how their personal information is used. If you would like to know whether we hold personal data about you, or you would like a copy of that information, you can make a Data Subject Access Request, often called a DSAR.

This page explains how to make a request, what information we may need from you, how we will respond, and what to do if you have any concerns about the way your request is handled.

1. What is a Data Subject Access Request?

A Data Subject Access Request is a request made by an individual who wants to know whether an organisation is processing their personal data and, if so, to receive access to that personal data together with certain additional information about how it is used.

This right helps people understand what information is held about them, why it is being used, who it may be shared with, and whether it is being handled lawfully and fairly.

2. Who can make a request?

You may make a request for your own personal data. In some circumstances, a request may also be made by someone acting on behalf of another person, such as a parent, guardian, attorney, representative, or another person with lawful authority to act for them.

Where a request is made on behalf of someone else, we may ask for evidence of authority before we release any information. This is to protect privacy and ensure that personal data is only disclosed lawfully and appropriately.

3. What information can you ask for?

You may ask us to confirm whether we process your personal data and, where applicable, request access to that data. You may also ask for related information about how and why the data is being used.

This may include information about the categories of personal data we hold, the purposes for which it is used, the categories of recipients with whom it may be shared, the source of the information where it was not collected directly from you, how long it may be retained, and your related data protection rights.

4. How to make a request

You can make a request by completing the form on this page, by contacting us in writing by email, or by writing to us by post. Requests may also be made verbally, but we recommend using the form or making the request in writing so that there is a clear record of what is being asked for and so that we can deal with the request as efficiently as possible.

5. What to include in your request

To help us identify your information and respond as quickly as possible, please include enough detail for us to understand what you are asking for. This may include your full name, current contact details, any previous names you have used, relevant dates, and a description of the records or information you would like to access.

It is helpful if you make your request as clear and specific as possible. For example, you may wish to tell us whether your request relates to care enquiries, service records, recruitment records, website enquiries, email correspondence, or another category of information.

6. Proof of identity

Before releasing personal data, we may ask you to provide proof of identity and, where appropriate, proof of address. This is an important safeguard to make sure that information is only disclosed to the correct person.

Where a request is made by a representative, we may also ask for evidence of the representative’s authority to act on behalf of the individual concerned. We may pause the request while we wait for this information if we reasonably need it to protect personal data.

7. How we will respond

Once we have received your request and any information reasonably needed to identify you and locate the relevant records, we will review it carefully and respond in line with the requirements of Jersey data protection law.

Where the request is valid, we will confirm whether we process your personal data and, where required, provide access to your personal data together with the additional information that the law says must be given.

8. Timescales

We aim to respond without undue delay and within the timescale required by law. In most cases, this means responding within four weeks of receiving a valid request and any information reasonably needed to confirm identity and understand the request.

If a request is particularly complex, broad, or involves a large volume of information, the law may allow additional time. Where that applies, we will let you know within the initial response period and explain why more time is needed.

9. Fees

A Data Subject Access Request will usually be dealt with free of charge. However, in limited circumstances permitted by law, a reasonable fee may be charged, for example where additional copies are requested or where a request is manifestly unfounded or excessive.

If a fee is applicable, we will explain the reason for it before taking the request any further.

10. Information you may receive

When responding to a request, we will provide your personal data in a form that is reasonably accessible and understandable. Depending on the circumstances, this may involve providing copies, extracts, schedules, summaries, or a combination of these.

The right of access is a right to your personal data. It is not necessarily a right to receive complete copies of every document in its original form, especially where documents contain information about other people or where another legal restriction applies.

11. Third-party information and redactions

When responding to a request, we must also protect the rights and freedoms of other people. This means that where documents contain information relating to another person, we may need to redact, summarise, or withhold parts of the document before disclosure.

Where possible, we will still provide your personal data in a meaningful way. However, there may be situations where certain information cannot be disclosed in full because doing so would unfairly reveal another person’s data or would otherwise be unlawful.

12. When we may refuse or limit a request

There may be circumstances in which we are entitled to refuse part or all of a request, or to limit what we provide. This may apply where a legal exemption exists, where disclosure would adversely affect the rights of others, where the request does not relate to personal data, or where the request is manifestly unfounded or excessive.

If we are unable to comply fully with your request, we will explain the position as clearly as we can, unless the law allows or requires us not to do so.

13. Requests made on behalf of children or other individuals

Where a request concerns a child or another person who may not be able to exercise their rights directly, we will consider the request carefully and in line with the law. We may need to assess whether the person making the request has the right authority to do so and whether disclosure is appropriate in the circumstances.

Our aim will always be to protect the rights, dignity, and privacy of the person whose personal data is involved.

14. Format and accessibility

If you need information in a particular format because of an accessibility need, please let us know when making your request. We will try to respond in a way that is clear, practical, and accessible wherever reasonably possible.

15. Other data protection rights

In addition to the right of access, you may also have other rights under Jersey data protection law. These may include the right to ask for inaccurate information to be corrected, the right to ask for data to be erased in certain circumstances, the right to restrict processing, the right to object to certain uses of data, and the right to data portability where applicable.

16. If you are unhappy with our response
